If a state has its own overtime laws, they will apply in that particular state. However, the federal Fair Labor Standards Act (FLSA) may also affect employees working within that state depending on their job duties and status. In cases where both federal and state law apply, the employee is generally entitled to the higher overtime pay rate.

Can teachers who instruct outside of the classroom be considered to have a primary duty of teaching? What about those who may have a primary duty of teaching, but do not instruct people enrolled in degree-seeking programs?
