the payment of service tax is based upon payment basis.
You have the liability to pay service tax only when u
receive the payment of the bill you issued to your client.n
the payment will be done on the 5th day (6th day in case of
e-payment) of the next month in which u recieve the payment.

For Service tax taxable event is when it is incurred but
tax has to be paid only if amount is recieved.Even if
advance is recieced tax has to be paid at the rate of
advance recipt ehich can later be adjusted

we are in business of lease rent and we are raising
invoice in which we charge service tax.
for eg rent 100000.00
service tax 12360.00
total 112360.00
out of which we received only rs.1 lacs and party is not
giving the service tax amount. What is the liability of our
should we deposit the service tax on the amount we received
or should we do not deposit the service tax. and the party
also refused to give the service tax as they are saying as
service tax is not applicable on renting of immovable
property.

Dear All, My query is related to capital gain on house property. If a pair of husband and wife have four houses in joint name comprising three residential house and last one is commercial property. Now question is that if they sold all property for Rs. 1.00 Crore and took a new residential property for Rs. 1.25 Crore. So are they eligible to full tax exemption u/s 54 and 54 f and they had to not pay any amount of Income tax? And they have also taken a Rs. 25.00 Lacs housing loan to invest the last one. My Question is regarding WCT. During an audit of a company, i saw a contractor consolidated invoice for installation at site in which it shows labour charges and goods supply separately and no service tax and vat is charged. The company pay the whole amount to contractor after deducting TDS. my question is whether WCT also deducted? if deducted at which rate if company in gurgaon?
