Hi All, I got H1B in the year 2008 and i have been there for 5 months and had my SSN and DL and i didnt hold any paystrubs and due to market down fall i was back to india and now am i eligible to apply in the same cap or need to go through fresh H1B filing. If fersh H1B filing what would be the questions as i dont have any paystrubs or will they ask about my previous working history. Kindly please suggest me in this regard. Thanks, Venkat

I was working inthe US on OPT and came to India to have my H1B stamped . I had been for my H1B visa interview last week feb 4th and was asked the following question. 1. What is your latest degree? 2. How many employees are working in your company? Me: around 30 3. Are all of them from India? Me: most of them she issued me 221(g) and asked me for the following documents: 1. Petitioner's Federal income tax return past 3yrs 2. Petitioner's State unemployment wage reports for past 3 years 3.List of petitioner's employees at your job site including names, titles , salaries and immigration status. I was wondering what are they trying to determine by determing how many employees are from India and are there chances of refusal if they find out 10 out of 30 are on H1
My H1B interview is scheduled next month. For docs relating to previous employer, I got only offer letter and experience cert only. I used to get salary in cash. I dont have pay slips also. I have got my H1B stamped at delhi in Oct 2008 from company X. Due to currect market situation company X has not sent me to USA. Now i resigned from company X and joined company Y. Please let me know if its possible to transfer the H1B visa on company Y.

My certificates(10+2 onwards) are having the Surname of my parents mentioned but my Passport(which was made based on 10th certificate where even my name was without surname and I made it after changing my name adding the surname) is not having the surname of my parents mentioned. My question is, will it be a problem for me when I apply the H1B visa? I do have the US B1 visa.
